The collection of the Pristav (bailiff) of the Vilnius Circuit Court contains daily registers and various records on the implementation of court decisions. The records cover such issues as debts collection, ownership of properties, seizure of property and assets, and inheritance rights.
Jewish-related materials include legal disputes between Jews, and between Jews and non-Jews. Consequently these materials illustrate the entrepreneurial activities of Jews and shed light on their business relations with non-Jews. For example a file from 1893-1895 contains documents on the successful claim of Jewish merchant M. Bramson against the nobles Michael and Maria Zelenko (inventory 2, file 707).
Records in the collection include information about judicial inquiries that were conducted not only between different individuals, but also between individuals and businesses or between businesses. For example, files from 1915 include materials on the collection of funds from the Jewish-owned company "I. Boruhson and Co" in favour of the firm "I.S. Grigoriev and Son" (inventory 2, file 799) and by the United Bank against T L Shofer and H A Disler (inventory 2, files 810, 811). There are also materials on the collection of funds from the Rubinstein family as a result of a lawsuit filed against them by the Vilna Commercial Bank in 1886 (inventory 1, file 339), and on collection of funds from M M Rabinovich and N Z Zalkind as a result of a lawsuit filed in 1896 by the Grodno Loan Society (inventory 2, file 726).
- Archival history:
- In 1940, after the imposition of Soviet rule in Lithuania, the consolidated Central State Archive of the Lithuanian SSR was founded in Vilnius. In 1956-1957 this archive was reorganised and divided into two separate central state archives. One archive was named the Central State Historical Archive of the Lithuanian SSR and was limited to the pre-1918 period. Thus, the materials of the Pristav (bailiff) of the Vilnius Circuit Court were included in this archive, which preceded the current Lithuanian Central State Archives.
- Administrative/biographical history:
- The post of Pristav (bailiff) at the different Russian courts was established following the judicial reform of 1864. The Vilnius Circuit Court established in 1883, also in accordance with the reform of 1864, was a court of first instance which dealt with civil and criminal cases. The law defined the Pristav as an official charged with assisting the court in its law-enforcement functions. Therefore, duties of the bailiff included delivery of summons and papers, and implementation of court decisions in civil cases including the sale of property of convicted persons. The bailiff was appointed by the court chairman and, in addition to his salary set by the state, received a monetary reward for performance of his duties which was collected from the debtors.
